Duties of Employers under WHS Regulations 2011

The regulations and the code of practice provides employers with guidance on hazard identification, assessment and risk control measures, consultation and the provision of training, information and instruction to employees. In addition to the general duty to control risk, employers are required to implement measures to control specific risks.
What do the regulations require of employers?
If you are a person conducting a business or undertaking, the regulations require you to manage and control risks that have been identified in an assessment in the workplace.
If you are an owner, or a business or person occupying a building, you have a legal obligation to ensure the safety of any person in that building in the event of a fire or hazardous materials emergency.
A Fire Safety Compliance Audit is conducted to assist owner/occupiers in managing their compliance with the Australian Standard 3745.
The Fire Safety Compliance Audit will investigate the following areas of your building:
Means of Escape from the building.
Occupancy limits for the building.
Maintenance of fire safety installations.
Evacuation planning, instruction and practice.
From the audit, a comprehensive report will be developed detailing the current level of compliance/non-compliance.
